SUIT AGAINST THE NIGERIAN GOVERNMENT

Allocation of pubic revenue to unelected local governments
 
Court to hear application to restrain allocation to Caretaker Committees, pending determination of suit
 
Dr Olisa Agbakoba has challenged the power of the Minister for Finance, Federation Accounts Allocation Committee and the Accountant General of the Federation (the Defendants) to allocate revenue to unelected local governments, from the Federation Account, in Suit FHC/L/770/2013, before Honourable Justice C. J. Aneke.
 
The Defendants while not denying allocating revenue to unelected local governments merely raised two procedural issues and one technical issue on locus standi and cause of action. They claim they are under duty to allocate funds to local governments.
 
The Plaintiff claims that the Defendants allocate over N46 billion to the local governments every month which approximates to N1 Trillion since the present government came to power in 2011. As a result Dr Agbakoba filed the claim and also the Application to restrain the Defendants from further allocating revenue to unelected local governments pending the determination of the Suit. The Application comes up for hearing in Court on Tuesday, July 8, 2014.
