Court orders uniform admission into Unity Schools

(NIGERIA) A Federal High Court sitting in Ikoyi, Lagos presided over by Justice James Tsoho, yesterday ordered Nigeria's Education Minister, Ibrahim Shekarau to apply uniform admission requirements, especially cut-off marks to all candidates seeking admission into Unity Schools across the country.

Besides, the judge also queried the disparity in the admission requirements into Unity Schools across the country.

Justice Tsoho in his ruling insisted that the action of the Education Minister in prescribing and applying different requirements for candidates seeking admission into Unity Schools is in violation of Section 42(1) of the 1999 constitution.

The judge further declared that the provisions of the constitution is superior to any administrative law or policies adopted by the Minister of Education.

The judge arrived at the decision consequent upon the fundamental human rights enforcement suit initiated by Senior Advocate Nigeria (SAN), Olisa Agbakoba, against the Attorney General of the Federation (AGF) and Minister of Education.

According to the suit, Agbakoba prayed the court to issue, "A declaration that the action of the Minister in prescribing and applying different requirements including cut-off marks for candidates seeking admission into Unity Schools is in violation of the constitution.

"An order directing the Minister of Education to apply uniform admission requirements especially cut-off marks to all candidates seeking admission into Unity Schools.

"An order of perpetual injunction restraining the Minister from further acts of discrimination in admission to Unity Schools."
